General Terms and Conditions of Sale

Article 1 — Purpose

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Kinico (Adam COURTARO, sole proprietor, SIRET 95262028400010) and any customer placing an order on the website https://kinico.shop.

Any order implies full and unconditional acceptance of these GTC.

Article 2 — Products

Kinico offers personalized artistic portraits generated by artificial intelligence from a photo provided by the customer, in one of six styles by theme (Aquarelle Pastel, Aquarelle Dorée, Encre du Japon, Botanique, Or Noir, Prisme).

The portraits are printed on one of the following two media: 200 g fine art paper poster, or canvas. Three sizes are available: 30 × 45 cm, 60 × 40 cm, and 90 × 60 cm.

The portrait is delivered as a print on the chosen medium. It is not sold framed: any frames shown in the website's presentation visuals are for staging purposes and are not part of the delivered product.

Each portrait is unique and personalized based on the photo provided by the customer.

Article 3 — Prices

Prices are indicated in euros, all taxes included (VAT included). The applicable VAT is that in force at the time of the order.

Delivery is free for all orders delivered in Europe.

Kinico reserves the right to modify its prices at any time. Products are invoiced at the price in effect at the time the order is confirmed.

Article 4 — Order

The order is validated after:

1. Upload of the photo by the customer

2. Generation and validation of the result by the customer

3. Selection of the medium and size

4. Full payment of the order

An order confirmation is sent by email to the address provided during the order process.

Article 5 — Payment

Payment is made online via Stripe, by credit card (Visa, Mastercard, American Express). Payment is secure and fully processed by Stripe. Kinico does not store any banking data.

Article 6 — Delivery

Orders are produced and shipped from the Netherlands via our European printing partner. The delivery time is 5 to 7 business days from the order confirmation, to destinations served in Europe.

For any delivery request outside Europe, the customer is invited to contact Kinico at contact@kinico.shop before placing an order.

Delivery is tracked. A tracking number is sent by email as soon as the order is shipped.

Kinico cannot be held responsible for delays attributable to the carrier.

Article 7 — Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to personalized goods made according to the consumer's specifications.

As Kinico portraits are personalized works created from a photo provided by the customer, they are excluded from the 14-day right of withdrawal.

Article 8 — Returns and refunds

Although the legal right of withdrawal does not apply, Kinico undertakes to:

- Defective product or production error: replacement or full refund upon presentation of a photo of the defect within 7 days of receipt.

- Result does not meet expectations: a new generation is offered to the customer free of charge.

- Change of mind: non-refundable, as the product is personalized.

Article 9 — Liability

The customer is solely responsible for the photos uploaded to the platform. They certify that they hold the rights to the photos provided and that these do not infringe on the rights of third parties.

Kinico declines all responsibility in the event of fraudulent or unlawful use of the photos provided by the customer.

Article 10 — Intellectual property

The portraits generated by Kinico are intended for the exclusive use of the customer. Kinico undertakes not to use the uploaded photos or the generated results for promotional or commercial purposes without the customer's explicit and prior consent.

Article 11 — Disputes

In case of dispute, the customer can contact Kinico at contact@kinico.shop. If an amicable resolution cannot be reached, the dispute will be submitted to the competent courts of the jurisdiction where Kinico's registered office is located.
